Employees who need help recognizing conflicts of interest depend on more than the existence of an ethics office. A final rule published by the U.S. Office of Government Ethics on November 2, 2016 assigns responsibilities across executive agencies, including to supervisors and agency heads. This November 11 retrospective revisits that earlier action; the rule is scheduled to take effect January 1, 2017. [2016-26418][2016-13152]

The final provisions make supervisors responsible for helping staff understand their obligations and know how to contact ethics officials. Agency heads must provide the designated ethics official with sufficient resources, including staff, and require other officials to supply necessary information and cooperation. The public-interest significance is an identifiable support structure for advice, rather than leaving every employee to locate help unaided. [2016-26418][2016-13152]

OGE’s June 6 proposal explains why responsibility extends beyond the specialist office. The agency said operations outside the designated official’s control could still be critical to the program’s success, while the earlier regulatory structure understated the agency head’s role. That diagnosis supplies the rationale for dividing responsibilities; it is not evidence that every agency had a deficient program or that the final revision had already repaired one. Our reading is that accountability becomes more concrete when resources and cooperation have named owners. Whether employees actually receive timely assistance remains a separate question requiring implementation evidence. The proposal and final rule belong to the same OGE proceeding, not independent evaluations of workplace practice. Their chronology supports an account of planned administration, not a claim that a holiday announcement or a new political event caused the revision. [2016-26418][2016-13152]
