Accurate oil measurement matters to the people entitled to royalties, not just to the operator reading a meter. BLM’s final rule, published November 17, 2016, replaces Onshore Oil and Gas Order Number 4 with minimum measurement standards for federal and Indian leases, excluding the Osage Tribe. Its purpose is reliable production accounting; publication alone does not establish that additional royalties have been collected. [2016-25405][2015-24008]

The September 30, 2015 proposal shows that accountability involved more than buying different equipment. It addressed measurement documentation, recordkeeping and performance standards, alongside a process for reviewing new technology. BLM contemplated an uncertainty calculator to help evaluate measurement systems and objective criteria for requests involving methods not expressly covered. That was a proposed tool, not evidence of a delivered service. [2016-25405][2015-24008]

Implementation also changed between proposal and final rule. The proposal allowed 180 days after effectiveness to bring existing equipment into compliance. The final rule instead provides a one-to-four-year phase-in linked to facility measurement point application timetables and production volumes, giving lower-volume producers more time. The final rule’s effective date is January 17, 2017, not a universal deadline to replace every existing installation. [2016-25405][2015-24008]

Our public-interest reading is that royalty protection depends on both credible measurement and workable execution. A longer transition does not prove weaker accounting, just as a new standard does not prove more revenue. The proposal and final rule are one BLM evidence chain, not independent audits. Their value here is documenting the accountability framework and its altered timetable, while leaving actual results to subsequent evidence. [2016-25405][2015-24008]
