A prepaid account can hold money needed for daily spending, making the treatment of a disputed transaction more than a paperwork question. The Consumer Financial Protection Bureau’s final rule, published November 22, 2016, extended tailored disclosure, limited-liability and error-resolution provisions to covered prepaid accounts. Its protection did not depend entirely on completing identity verification. [2016-24503][2014-27286]

That distinction changed the approach in the proposal published December 23, 2014. The proposal would have excluded unregistered accounts from specified liability and error-resolution requirements. The final rule instead applied those requirements regardless of verification, while allowing institutions not to provide provisional credit for unverified accounts. A right to have an error addressed therefore was not identical to temporary access to the disputed funds. [2016-24503][2014-27286]

The disclosure provisions addressed another source of consumer exposure: understanding an account before acquiring it. Institutions generally had to provide short and long forms, with conditional alternative timing for the long form in retail and telephone acquisitions. The shorter document emphasized key fees; the longer one supplied a comprehensive fee list and assessment conditions. That design sought to make comparisons possible rather than establish that every account was inexpensive. [2016-24503][2014-27286]

For a household, the useful distinction is between information before choosing an account and remedies after a problem. Neither means every stored-value product qualifies; gift cards and other defined categories were excluded. As published, the general effective date was October 1, 2017, with a specified agreement-submission provision following in 2018. These same-chain proposal and final documents establish the design, not reduced household losses. [2016-24503][2014-27286]
