A broadband customer's browsing history became a specific subject of the FCC privacy framework published December 2, 2016. The adopted rules treat browsing and application histories as sensitive information, alongside health, financial and precise location data. For households, the important change is a decision over information use, rather than a promise that their provider will stop collecting all data. [2016-28006][2016-08458]

The framework calls for affirmative permission to use or share sensitive customer information and an opportunity to refuse uses of nonsensitive information. Statutory exceptions remain, including using information to provide broadband service. That distinction matters: delivering a communication and obtaining permission for other uses are not the same transaction. [2016-28006][2016-08458]

The April 20 proposal supplied the underlying public-interest question. It argued that customers cannot give meaningful permission without understanding what providers collect and do with it. The final framework adds defined consent categories, reasonable security measures and notification of breaches that could cause harm. These documents trace one FCC proceeding, not independent evidence of improved privacy. [2016-28006][2016-08458]

Publication did not activate every protection. The notice lists January 3, 2017 generally and March 2 for security; specified provisions await approval of information collections and phased implementation. Notice and choice also have a twelve-month minimum implementation period, with additional time for small carriers. The bargaining-power test is therefore practical: whether understandable notices and usable choices eventually support the decision the framework assigns to customers, not whether publication alone changes their experience.
