A shopper cannot reconstruct a fish's journey from the label alone. The seafood import rule published December 9, 2016 sought to give U.S. authorities a documentary route back to harvest for selected species and products. The National Marine Fisheries Service established permit, entry-reporting and record-retention requirements aimed at illegal fishing and seafood fraud, not a new consumer guarantee covering every fish on sale. [2016-29324][2016-02216]

The February 5 proposal had described that harvest-to-entry model through the existing federal trade-data system, including an annually renewable fisheries trade permit. The final rule turned the design into specified importer obligations. The two documents show how one agency developed its approach; they are not separate evidence that fraud declined or that legitimate fishers received higher prices. [2016-29324][2016-02216]

For the importer of record, submitting harvest data and retaining the wider chain of custody were different tasks. The final required supporting records to remain available for two years from import. It allowed aggregated harvest reports and did not require every portion of a shipment to be matched to an individual harvest event. That distinction keeps a traceability account from promising more precision than the rule demanded. [2016-29324][2016-02216]

The original calendar set January 9, 2017 effectiveness and January 1, 2018 compliance for the listed initial species. Shrimp and abalone were deferred pending further agency action, not permanently exempted. Some products whose species or harvest could not feasibly be identified were outside the reporting requirement. The public-interest test would be whether usable records support enforcement; publication alone could not establish that result. [2016-29324][2016-02216]
