Covered suppliers of fluorinated heat-transfer fluids face a new counting task in EPA's broad reporting amendments published December 9, 2016. This December 11 weekend retrospective concerns that Friday publication. Starting with reporting year 2018, the final rule adds fluids that are not themselves fluorinated greenhouse gases to the relevant supplier reporting requirements. [2016-28564][2015-32753]
The figures concern emissions that would result if the fluids were released, covering quantities produced, imported, exported, transformed or destroyed. They are not measurements proving that those quantities reached the atmosphere. Nor does the provision place every business using a heat-transfer fluid in the same reporting category. Those boundaries matter to people trying to understand industrial environmental information. [2016-28564][2015-32753]
EPA's January 15 proposal had described a mixed workload: expanding coverage or reporting could add burdens, while removing requirements or simplifying data could reduce them. That is a useful public-interest question, not evidence of costs already passed to workers or households. The proposal and final rule trace one agency process; they do not independently establish who ultimately pays. [2016-28564][2015-32753]
The final amendments have instruction-specific effective dates on January 1 in 2017, 2018 and 2019. A staggered calendar makes the reporting work less simple than a single announcement suggests. Public accountability depends on identifying which information is being collected and from whom. EPA described better-quality, more consistent data as an objective; these documents do not demonstrate improved community conditions or emissions reductions. [2016-28564][2015-32753]
