Patients use a medical product as a whole, even when its regulatory responsibilities are divided. FDA's December 20, 2016 final rule addressed safety reporting after marketing authorization for combinations of two or more product types: drugs, devices or biological products. The public-interest issue was whether information about harm would reach the applicants responsible for the different parts. [2016-30485][E9-23519]
FDA's October 1, 2009 proposal had explained the underlying problem through reporting design. It proposed keeping the reporting framework associated with the product's application while adding requirements reflecting constituent parts' distinctive characteristics. That rationale matters because the application category alone was not the whole safety picture. The proposal was a stage in this same rulemaking, not an independent assessment of patient outcomes. [2016-30485][E9-23519]
The final rule gave constituent-part applicants a defined handoff: share received information about specified deaths, serious injuries or adverse experiences with the other constituent-part applicants within five calendar days of receipt. That is not a deadline for every manufacturer or every incident. FDA removed an alternative allowing this sharing obligation to be met through FDA alone; separate reporting to the agency remained. [2016-30485][E9-23519]
Timing qualifies the protection described. The rule set January 19, 2017 as its effective date, with existing application-based duties on that schedule, but deferred compliance with specified additional provisions, including section 4.103 sharing, for 18 months afterward. The mechanism makes responsibility more explicit. It does not establish that fewer patients were harmed, or that the new handoff was already operating on publication day. [2016-30485][E9-23519]
