Small suppliers need not sell directly to a federal prime contractor for their work to count toward its small-business subcontracting goals under an SBA rule published December 23, 2016. The change covers other-than-small primes with individual contract plans. It recognizes qualifying awards farther down the supply chain, not a new entitlement to work or financing. [2016-30874]
The agency’s October 6, 2015 proposal described the earlier first-tier focus: a prime received goal credit for its direct subcontract awards. That helps explain the public-interest stake in the final change. A smaller firm supplying another contractor can contribute to a federal contract without appearing among the prime’s direct suppliers. Recognizing that work is different from showing that more small firms won business. [2015-25234][2016-30874]
Recognition depends on records. The final rule separates first-tier and lower-tier goals, drawing on the prime’s own first-tier reporting and qualifying subcontractors’ first-tier reports. Covered subcontractors retain their plans and reporting duties, and the prime remains responsible for accurate reports to government. Visibility for smaller suppliers therefore comes with a chain of responsibility, not permission to add every reported total together. [2016-30874]
The proposal expressly warned against counting the same award twice or three times. Both stages exclude commercial and comprehensive plans from this lower-tier credit mechanism. The final rule sets January 23, 2017 as its effective date. These records trace one rulemaking, not independent evidence of improved livelihoods. For affected suppliers, the unresolved question is whether recognition in contracting goals translates into additional opportunities; neither document establishes that result.
