A lower purchasing ceiling for a health provider is not the same thing as a lower bill for its patient. HRSA's January 5, 2017 rule addresses the first transaction: manufacturers' sales of covered outpatient drugs to eligible participants in the U.S. 340B program. It finalizes calculation rules and potential penalties for overcharging those covered entities, rather than setting everyone's pharmacy price. [2016-31935]

One protection concerns what happens at the bottom of the formula. The final text sets a one-cent ceiling per unit of measure when the calculation yields less than one cent. That is a conditional pricing rule, not an announcement that every medicine supplied through 340B costs a penny. Eligible purchasers and covered drugs remain essential boundaries. [2016-31935]

The June 17, 2015 proposal explains why that exception matters. It proposed penny pricing rather than letting a manufacturer substitute a previous quarter's price, wholesale acquisition cost or another non-340B contract price. Those substitutions would defeat the formula, the agency argued. The proposal and final rule trace one policy process, not two independent demonstrations of savings for patients. [2016-31935][2015-14648]

Accountability also has a defined threshold. A manufacturer with a pharmaceutical pricing agreement that knowingly and intentionally overcharges may face a civil monetary penalty, separate from repayment. The original rule specified March 6 effectiveness, while HRSA planned enforcement from the quarter beginning April 1, 2017. For readers following affordability, the concrete change is protection of covered purchasing terms; the documents do not establish a reduction in any household's out-of-pocket spending. [2016-31935]
