A worker should not have to infer from a revised procurement clause that an old promise of silence has changed. The federal contracting rule published January 13, 2017 requires covered contractors to notify current employees and subcontractors when existing internal confidentiality restrictions conflict with its protection for lawful reporting. [2016-31497]

The protected channel is specific: reports of waste, fraud or abuse related to government-contract performance to designated federal investigative or law-enforcement representatives authorized to receive them. An agency inspector general is one example. The rule is not permission to publish confidential information, and its definition excludes civil-litigation agreements and agreements required by a federal agency. [2016-31497]

The January 2016 proposal shows why confidentiality and accountability were treated together. It proposed implementing a congressional funding restriction while expressly preserving classified-information nondisclosure requirements, including Standard Form 312 and Form 4414. The final rule retains that boundary. These are stages of one rulemaking, not separate evidence that retaliation or fraud actually declined. [2016-31497][2016-01050]

Scheduled effectiveness was January 19. Implementation concerned fiscal year 2015 and later covered funds, with exceptions for specified personal-services contracts with individuals. Existing covered contracts needed the clause before relevant funds were obligated. For employees, the distinctive practical mechanism is the notification requirement: the change must reach people already bound by conflicting language, rather than remain only in the next contract file.
