A person considering a research study needs more than a form to sign. The Common Rule revision published January 19, 2017 requires understandable information and an opportunity to discuss whether to participate. This January 20 retrospective concerns that prior-day publication, not an inauguration-day decision. Its focus is the relationship between investigators and prospective participants, rather than the quality of clinical treatment. [2017-01058]
The September 2015 proposal had identified a practical obstacle: important information could be buried in long consent documents. It sought presentation that highlighted what mattered to the decision. The final text specifies a concise, focused opening with key information explaining reasons to join or decline, except for broad consent. It does not replace comprehension with a universal page limit. [2017-01058][2015-21756]
The final also requires circumstances that allow sufficient consideration and minimize coercion or undue influence. Those provisions matter because organizing a document and allowing a conversation are different tasks. A short opening can direct attention, but the rule still requires information in language the person understands and an opportunity to discuss it. The agency's design does not itself demonstrate better understanding. [2017-01058]
The original publication scheduled effectiveness and general compliance for January 19, 2018, while the single-review-board provision in section __.114(b) had a January 20, 2020 compliance date. That later provision does not postpone all consent duties. Proposal and final rule are one policy-development chain, not independent evidence that participants gained protection; they show which parts of the decision-making process the agencies sought to improve.
