For the staff preparing a controlled shipment, a friendlier licensing policy does not replace the documents needed to move goods. Two Bureau of Industry and Security rules published January 19 illustrate that distinction. One changes conditional licensing policy for India; the other schedules supporting-document requirements for specified shipments involving Hong Kong. They do not establish staffing costs or jobs created. [2017-00439][2017-00446]
India's rule, effective January 19, establishes a general approval policy for applications involving items controlled only for National Security or Regional Stability reasons, including 600-series items. It covers specified civil or military end uses in India, ultimate Indian-government use, reexport to Country Group A:5 or return to the United States. Nuclear, missile and chemical or biological weapons activities are excluded. An application still matters. [2017-00439][2017-00446]
The Hong Kong rule schedules April 19 effectiveness. For covered exports or reexports to Hong Kong under a BIS license or license exception, the shipper must possess a covering Hong Kong import-license copy valid at shipment, or a government statement that no import license is required. Coverage concerns National Security, Missile Technology, Nuclear Nonproliferation column 1, or Chemical and Biological Weapons controls. [2017-00439][2017-00446]
That places a concrete future check at the shipping stage, not necessarily at the license-application stage. The documents must also be retained under the specified recordkeeping rules. These two instruments come from the same agency, not independent workplace research. Their practical lesson is narrower: a policy about deciding applications and a requirement to hold shipment documents leave different tasks for the people carrying out a transaction.
